These terms apply when you buy from Toybox Ross through this website. They're written to be read. Please take a few minutes to do so before you order, and keep a copy of your order confirmation email. They apply to consumers; nothing in them reduces your legal rights.
1. Who we are
Toybox Ross is a trading name of TOY BOX (ROSS) LIMITED, a company registered in England and Wales with company number 10894743. Registered office: The Threshing Barn, Fownhope, Hereford, HR1 4PU, United Kingdom.
Our shop is at 15 Broad Street, Ross-on-Wye, Herefordshire, HR9 7EA. You can reach us on 01989 565322 or at toyboxross@gmail.com. In these terms “we” and “us” mean TOY BOX (ROSS) LIMITED (trading as Toybox Ross).
2. Placing an order
- You add items to your basket, choose Click & Collect or delivery, review your order and total, and then pay on a secure payment page. You can check and correct your basket at any point before you pay.
- Your order is an offer to buy. The contract between us is made when we send your order confirmation email, which we do once your payment has gone through.
- If we can't supply something you've paid for (see section 8) we'll tell you and refund you in full for it.
- You must be 18 or over to order from this website.
- A few items are limited to a set number per customer so that more families can get one. Any limit is shown on the product page and applied in your basket.
- Contracts are concluded in English.
3. Our products
- We take care to describe and photograph products accurately. Packaging and small details can change between production runs, and colours can look a little different from screen to screen.
- Where a product is sold in assorted designs or colours, we say so, and the design you receive is chosen for you.
- Ages. Where we show a manufacturer's recommended age it comes from the manufacturer. The age groups used to browse the shop (“Shop by age”) are our own suggestions to help you find ideas; they are not safety advice. Always check the age marking and any warnings on the packaging before giving a toy to a child, especially a child under three.
- The website shows what our shop has in stock. Stock is shared with the shop floor, so availability can change quickly.
4. Prices and payment
- Prices are in pounds sterling and are the full price you pay for the item, including any VAT that applies. Delivery, if you choose it, is shown separately before you pay.
- The price that applies is the one shown when you place your order. Prices on the website and in the shop can change at any time, but changes never affect an order we have already confirmed.
- If we discover an obvious pricing mistake after you've ordered, we'll contact you and you can choose to go ahead at the correct price or cancel for a full refund.
- Payment is by debit or credit card (including Apple Pay and Google Pay where your device supports them), taken in full when you order. Payments are processed by Stripe; we never see or store your full card details.
5. Delivery and collection
- Delivery is a flat £4.99 per order to addresses in the United Kingdom. Click & Collect from our shop is free. Full details are on our Delivery page.
- Unless we agree a different date with you, we will deliver within 30 days of the day we confirm your order. If we miss that, you can treat the contract as at an end and have a full refund.
- The goods are your responsibility from the moment they are delivered to you (or to someone you've asked to receive them), or the moment you collect them. You own them once we have received payment in full.
- If you choose Click & Collect and can't collect, please tell us. If we don't hear from you we'll try to contact you, and if the order still isn't collected within a reasonable time we may cancel it and refund you.
6. Your right to cancel
You have a legal right to change your mind and cancel an online order at any time up to 14 days after the day you receive it, and a further 14 days after telling us to return it. 7. If something is wrong
We are under a legal duty to supply goods that are as described, of satisfactory quality and fit for purpose. If yours aren't, the Consumer Rights Act 2015 gives you the right to a refund, repair or replacement, depending on the circumstances. See faulty, damaged or wrong items, and please tell us as soon as you can so we can put it right.
8. When we may cancel
We may have to cancel an order, or part of one, and refund you if:
- an item turns out to be out of stock, damaged or no longer available;
- there was an obvious error in the price or description;
- we can't deliver to your address;
- payment is declined, reversed or we reasonably suspect fraud;
- the order is over a per-customer limit, or appears to be for resale.
If we cancel, we'll tell you promptly and refund everything you paid for the cancelled items.
9. Our responsibility to you
- If we fail to keep to these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking the contract or failing to use reasonable care.
- We do not exclude or limit our liability where it would be unlawful to do so. That includes liability for death or personal injury caused by our negligence, for fraud, for defective products under the Consumer Protection Act 1987, and for breach of your legal rights about the goods.
- We sell for domestic and private use. We are not liable for business losses such as loss of profit or business interruption.
- We are not responsible for delays or failures caused by events outside our reasonable control. If that happens we'll tell you, and you can cancel for a refund if the delay is substantial.
10. Using this website
- The website and its content belong to us or to those who have licensed it to us. Brand and product names belong to their owners. You're welcome to use the site to browse and shop; please don't copy it, misuse it or try to interfere with how it works.
- We do our best to keep the website available and accurate, but we can't promise it will always be uninterrupted or error-free.
- Your basket and wishlist are saved on your own device. See our Cookie policy.
11. Your personal information
We use your details to take payment, fulfil your order and look after you as a customer. Our Privacy policy explains what we collect and why.
12. Complaints and disputes
If you're unhappy, please tell us: see how to complain. If we can't resolve things between us, we'll tell you about an approved alternative dispute resolution provider and whether we're willing to use them.
These terms are governed by the law of England and Wales. You can bring a claim in the courts of England and Wales. If you live in Scotland or Northern Ireland you can also bring a claim in your local courts, and you keep the protection of the consumer law that applies where you live.
13. Other important terms
- We may update these terms from time to time. The terms that apply to your order are the ones on this page on the day you place it.
- If a court finds part of these terms unenforceable, the rest continue to apply.
- If we don't insist straight away that you do something these terms require, we can still ask you to do it later.
- This contract is between you and us. Nobody else has rights under it.
